Terms of Service

1. Acceptance of terms

By accessing or using NeverMiss (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree, do not use the Service.

2. Description of the Service

NeverMiss monitors emails sent from a registered organization domain and automatically creates calendar events in members' connected Google Calendar or Microsoft Outlook calendar. The Service is intended for use by educational institutions, clubs, and organizations to help their members stay informed about upcoming events.

3. Accounts and access

  • You must sign in using a valid Google or Microsoft account to use the Service.
  • You are responsible for maintaining the security of your account.
  • Access to the Service is granted through an invite link issued by your organization's administrator.
  • You may not share your invite link with people outside your organization.
  • We reserve the right to suspend or terminate accounts that misuse the Service.

4. Use of Google and Microsoft data

By connecting your inbox and calendar, you grant NeverMiss permission to:

  • Read unread emails from your inbox to identify messages sent from your organization's registered domain.
  • Create calendar events on your behalf when events are detected in those emails.
  • Mark processed emails as read.

You can revoke this access at any time from your Google or Microsoft account settings, or by disconnecting your inbox from the NeverMiss dashboard. NeverMiss's use of data obtained through Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to access another user's account or data.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service to monitor emails from domains you do not own or have authorization to use.
  • Reverse engineer or attempt to extract the source code of the Service.

6. Subscriptions and billing

  • The Service is offered under subscription plans billed monthly or annually.
  • Subscriptions auto-renew unless cancelled before the renewal date.
  • To cancel, contact us at hello@nevermiss.cr and we will process your cancellation promptly.
  • We do not offer refunds for partial billing periods except where required by law.
  • We reserve the right to change pricing with 30 days' notice to active subscribers.

7. Availability and service level

We strive to keep the Service available and running reliably, but we do not guarantee uninterrupted access. The Service checks for new emails approximately every 5 minutes. We are not liable for missed events caused by downtime, email delivery delays, or third-party service outages (Google, Microsoft, etc.).

8. Limitation of liability

To the fullest extent permitted by law, NeverMiss shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including missed events, incorrect event details, or calendar errors. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

9. Intellectual property

All rights in the Service, including its design, code, and content, are owned by NeverMiss. Nothing in these terms grants you any right to use our trademarks or branding.

10. Termination

We may suspend or terminate your access to the Service at any time if you violate these terms or if your subscription lapses. Upon termination, your OAuth tokens will be deleted and no further emails will be monitored. Events already added to your calendar will remain.

11. Changes to these terms

We may update these terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after changes are posted constitutes acceptance of the updated terms.

12. Governing law

These terms are governed by the laws of Costa Rica. Any disputes shall be resolved in the courts of San José, Costa Rica.
